What Is the EU AI Act?

- 2 February 2025: Ban on prohibited AI systems fully applies (no more grace period).
- 2 August 2025: Codes of practice for general-purpose AI models must be ready.
- 2 August 2026: Full application of the Act. This is the big one. High-risk AI obligations, transparency requirements, and Article 4 AI literacy mandates all apply.
- 2 August 2027: Obligations for high-risk AI systems already on the market fully apply.

The Risk-Based Framework: Four Categories
The EU AI Act doesn’t treat all AI the same way. It uses a tiered approach based on risk to fundamental rights and safety.
1. Unacceptable Risk (Prohibited)
These AI practices are banned outright because they’re considered incompatible with EU values and fundamental rights.
Examples:
- Social scoring systems (like China’s social credit system)
- Real-time biometric surveillance in public spaces (with narrow exceptions for law enforcement)
- Subliminal manipulation (AI designed to exploit vulnerabilities to alter behaviour)
- Exploitation of vulnerable groups (e.g., voice-activated toys that encourage dangerous behaviour in children)
If your AI system does any of these things, you cannot deploy it in the EU. Full stop.
2. High Risk
These are AI systems that could significantly harm health, safety, or fundamental rights. They face strict requirements before and after deployment.
High-risk AI includes:
- Biometric identification systems (e.g., facial recognition at borders)
- Critical infrastructure management (AI controlling water, gas, electricity)
- Educational/vocational training (AI that determines access to education or grades exams)
- Employment decisions (CV screening, interview analysis, promotion algorithms)
- Credit scoring and creditworthiness assessments
- Law enforcement (AI predicting crime, analysing evidence)
- Migration and border control (AI assessing visa applications)
If you’re using AI to make or significantly influence decisions about people’s jobs, finances, or access to services, you’re almost certainly in the high-risk category.
Requirements for high-risk AI:
- Risk management system throughout the AI lifecycle
- High-quality training, validation, and testing datasets
- Technical documentation and record-keeping
- Transparency and information to deployers
- Human oversight measures
- Accuracy, robustness, and cybersecurity standards
- Conformity assessment before market placement
- Registration in an EU database

3. Limited Risk (Transparency Obligations)
These AI systems carry some risk but primarily require transparency so users know they’re interacting with AI.
Examples:
- AI chatbots (must disclose they’re not human)
- Deepfakes (must be clearly labelled)
- Emotion recognition systems (users must be informed)
- AI-generated content (must be detectable as synthetic)
The rule: users must know when they’re dealing with AI, not a human. No sneaky chatbots pretending to be real people.
4. Minimal or No Risk
